These Terms of Service govern the use of tommynkai.com and purchases made through the Tommy & Kai online store.

Tommy & Kai is operated by EGS SRL, a company established in Belgium.

By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Returns & Refunds Policy and Shipping Policy.

Nothing in these Terms limits any mandatory rights granted to consumers under applicable law.

2. Products

We take reasonable care to ensure that product descriptions, photographs, specifications, sizing information and other information displayed on our website are accurate.

However, minor differences in colour or appearance may occur due to screen settings, lighting, natural materials or normal manufacturing variations.

For products made from natural materials such as leather, variations in grain, texture or shade may occur and are part of the natural characteristics of the material.

Such variations do not affect your statutory rights where a product does not conform to the contract.

Product availability may change and we reserve the right to discontinue products or update product information when reasonably necessary.

3. Sizing & Fit

For size-dependent products, customers should carefully consult the Fit Guide and measure their pet before ordering.

If you are unsure about the appropriate size, we encourage you to contact Tommy & Kai Customer Care before placing your order.

Our sizing assistance is intended to help you make an informed choice but does not replace your responsibility to provide accurate measurements.

Your statutory consumer rights and our Returns & Refunds Policy remain applicable.

4. Orders

Submitting an order constitutes an offer to purchase the selected products.

After your order is submitted, you will receive an electronic confirmation.

We reserve the right to refuse or cancel an order where reasonably justified, including in cases of:

• payment failure or suspected fraud;

• manifest pricing or product information errors;

• product unavailability;

• inability to deliver to the requested destination;

• misuse of promotional offers;

• orders reasonably suspected to be intended for unauthorized commercial resale.

If we cancel an order after payment has been received, the corresponding amount will be refunded.

Once an order enters fulfilment, cancellation may no longer be operationally possible. This does not affect any statutory right of withdrawal applicable after delivery.

5. Prices & Payment

Prices displayed on the website are shown in the applicable currency and include VAT where required by applicable law, unless clearly stated otherwise.

Any delivery charges applicable to your order will be shown before you confirm your purchase.

The total amount payable will be displayed before the order is submitted.

Payment must be successfully authorized before an order can be processed.

6. Shipping & Delivery

Orders are delivered to the shipping address provided during checkout.

Estimated delivery periods are provided on our website or during checkout. Delivery estimates may be affected by circumstances outside our reasonable control, including carrier disruption, customs procedures, severe weather or other exceptional events.

We will nevertheless fulfil our obligations concerning delivery in accordance with applicable consumer law.

Where Tommy & Kai arranges delivery to a consumer, the risk of loss or damage remains with Tommy & Kai until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.

7. Returns & Right of Withdrawal

Consumers who benefit from a statutory right of withdrawal may exercise that right within the applicable legal period.

For eligible EU consumer purchases, this generally means 14 calendar days from receipt of the goods.

For returns resulting from a change of mind, personal preference or incorrect size selection, the direct cost of returning the goods may be borne by the customer where permitted by law and as described in our Returns & Refunds Policy.

Returns are handled through our Belgian return location.

8. Legal Guarantee & Product Conformity

Products sold by Tommy & Kai benefit from the statutory legal guarantee applicable under consumer law.

For new consumer goods sold to consumers in Belgium and where Belgian consumer law applies, the statutory conformity guarantee is two years from delivery.

This legal guarantee covers qualifying lack of conformity existing under the conditions established by applicable law.

The legal guarantee is separate from the 14-day right of withdrawal.

Nothing in these Terms or in any Tommy & Kai policy excludes, restricts or replaces your mandatory statutory guarantee rights.

If you believe a product is defective or non-conforming, please contact Tommy & Kai Customer Care with your order details and information about the issue.

9. Proper Use of Products

Products must be used appropriately and in accordance with their intended purpose.

Pet products should be regularly inspected for signs of wear, damage or deterioration.

A collar, leash, accessory or other pet product that has become damaged or excessively worn should no longer be used where continued use could create a safety risk.

Pet owners remain responsible for selecting products appropriate to their animal's size, condition and intended activity and for supervising their use where reasonably required.

Nothing in this section excludes or limits liability that cannot legally be excluded.

10. Intellectual Property

Unless otherwise indicated, the Tommy & Kai brand, website design, original text, graphics, logos and other original brand content are owned by or licensed to EGS SRL and are protected by applicable intellectual property law.

Content may not be reproduced, commercially exploited or distributed without prior authorization except where permitted by law.

Third-party trademarks and content remain the property of their respective owners.

11. Reviews & Customer Content

If you voluntarily submit a review, photograph, testimonial or other content to Tommy & Kai, you confirm that you have the right to provide that content.

You grant EGS SRL a non-exclusive, worldwide, royalty-free licence to display and use that content in connection with Tommy & Kai, including on our website and marketing channels, subject to applicable law.

We reserve the right to remove content that is unlawful, abusive, misleading, fraudulent or infringes the rights of others.

12. Website Availability & Third-Party Services

We aim to keep our website accurate, secure and available but cannot guarantee uninterrupted availability at all times.

Our website may contain services, functionality or links provided by third parties, including Shopify and payment providers.

Those third parties may operate under their own terms and privacy policies.

13. Liability

EGS SRL remains responsible where liability cannot legally be excluded or limited.

To the extent permitted by applicable law, EGS SRL will not be responsible for losses resulting from:

• improper or unintended use of a product;

• continued use of a visibly damaged or excessively worn product;

• inaccurate information supplied by the customer;

• circumstances outside our reasonable control;

• indirect commercial losses arising from purchases made for purposes outside normal consumer use.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury where such liability cannot legally be excluded, or any other liability or consumer right that cannot be excluded under applicable law.

14. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable data protection legislation.

Our store is powered by Shopify, which may process certain information in connection with providing its commerce services.

15. Changes to These Terms

We may update these Terms where reasonably necessary to reflect changes to our services, business operations or applicable law.

The version applicable to your purchase is the version in force when your order is placed, unless mandatory law provides otherwise.

16. Governing Law & Consumer Rights

These Terms are governed by Belgian law, without depriving consumers residing in another country of any mandatory protections granted to them by the law applicable to their situation.

Nothing in these Terms restricts a consumer's right to bring proceedings before a competent court where that right is provided by applicable consumer law.
